HB556 Summary

• Amends Section 11-52-33 of the Code of Alabama 1975 relating to municipal subdivision development and land sales regulations.

• Adds protection stating that nothing in the section shall impair, impede, or prohibit any person or entity from entering into a valid and enforceable contract for the purchase or sale of any lot within a proposed subdivision prior to its approval.

• Maintains existing $100.00 penalty per lot for conveying, transferring, or selling land by reference to an unapproved subdivision plat before approval by the appropriate municipal or county commission, department, or agency.

• Preserves existing remedies allowing municipalities or counties to seek injunctions or recover penalties through civil action for unauthorized subdivision land sales.

• Becomes effective immediately upon passage and approval by the Governor or upon becoming law.
