HB598 Summary

• Adds Section 11-67-60.1 to the Code of Alabama 1975 to authorize municipal governing bodies to adopt alternate procedures for declaring overgrown grass and weeds as public nuisances.

• Allows municipalities to abate overgrown grass and weeds through procedures established in municipal ordinances, rather than solely following existing state procedures.

• Costs of abatement are assessed and collected as weed liens in the same manner as provided in Section 11-67-66, Code of Alabama 1975.

• Municipalities may assess abatement costs against property purchased by the State of Alabama or at tax sales, and such liens survive property redemption or subsequent state sales.

• Exempts property acquired by the State Land Bank through the Department of Revenue from lien discharge provisions.
