HB604 Summary

• Amends Section 36-26-35 of the Code of Alabama 1975 regarding state employee annual leave accumulation and payment.

• Law enforcement officers in the Department of Public Safety are entitled to receive payment for accrued and unused annual leave days in excess of 60 days, up to a maximum of 10 days per year, calculated at their regular rate of pay.

• All other state employees subject to the Merit System and legislative personnel may receive payment for accrued and unused annual leave days in excess of 60 days, up to a maximum of 10 days per year, unless proration has been declared.

• Individual departments, agencies, boards, or commissions have sole discretion to determine payment amounts (from zero to 10 days) and may not make such payments if it prevents paying merit raises to employees; all qualifying employees within each entity must be treated equally.

• The act becomes effective immediately upon passage and approval by the Governor, or upon otherwise becoming law.
