HB693 Summary

• Authorizes Walker County Commission to declare abandoned, wrecked, nonoperative, or unsafe manufactured dwellings and other dwellings outside municipal corporate limits as public nuisances if they endanger health, safety, or welfare.

• Requires county commission to appoint employee(s) to assess nuisances and notify property owners with at least 60 days to abate the condition by mutual agreement.

• Establishes formal hearing process where county commission must post notice at least 10 days prior to hearing and consider property owner objections before declaring property a public nuisance.

• Makes abatement costs a lien on the property, collected with property taxes by the county revenue commissioner with same penalties and foreclosure procedures as ordinary county taxes.

• Authorizes county commission to enforce the act through civil actions seeking court judgments for all abatement costs including attorney's fees, court costs, and litigation expenses against the person creating or maintaining the nuisance.
