SB1 Summary

• Amends Section 29-2-4 of the Code of Alabama 1975 to grant the Joint Transportation Committee power to call for and conduct administrative hearings regarding civil disputes or conflicts between the Alabama Department of Transportation and private business individuals and entities.

• Authorizes the committee to compel attendance of witnesses and provide documents and data necessary to conduct hearings, with advisory opinions issued after reviewing all testimony and facts.

• Hearings shall strive to be consistent with concepts of judicial equity and may follow guidelines from the Alabama Center for Dispute Resolution, though adherence is not required.

• Clarifies that administrative remedies provided under this act are not exclusive and do not require consumers or injured parties to exhaust administrative remedies before pursuing other legal remedies.

• Effective date is the first day of the third month following passage and approval by the Governor.
