SB118 Summary

• Adopts the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act to establish jurisdiction standards for adult guardianship and conservatorship cases involving parties in different states.

• Defines jurisdiction based on respondent's home state (6+ consecutive months residence), significant-connection state, or emergency circumstances, with procedures for courts to communicate and cooperate across state lines.

• Establishes procedures for transferring guardianships and conservatorships between states, including provisional and final orders, and requirements for accepting transferred proceedings with 90-day modification review.

• Permits guardians and conservators appointed in other states to record their orders in Alabama to exercise authority over property and estate management without requiring new appointments.

• Becomes effective January 1, 2011, and amends existing guardianship law sections to reference the new jurisdiction act while preserving probate court equity jurisdiction.
