SB126 Summary

• Department of Corrections may contract with county commissions to design, construct, and operate regional detention facilities housing up to 300 state offenders and 50 county offenders.

• Contracts may not exceed 20 years but may include 3% annual price increases; Department of Corrections pays a per-day fee for each state offender housed (amount to be determined).

• County sheriff assumes responsibility for facility management and care of state offenders under Department of Corrections direction, and receives additional compensation for these duties (amount to be determined).

• Sheriff may arrange work agreements for state offenders with county commission and Department of Corrections approval; political subdivisions receive free offender labor but must reimburse facility for transportation, guards, meals, and other costs.

• All facilities must comply with American Correctional Association standards, constitutional requirements, and court orders; act becomes effective on the first day of the third month following passage and gubernatorial approval.
