SB 182 Summary

• Adopts the Uniform Child Abduction Prevention Act to clarify procedures for preventing child abduction in custody disputes where a credible risk exists.

• Allows courts to order abduction prevention measures on their own motion or upon petition from a parent, guardian, or other individual with custody rights, including travel restrictions and passport alert registrations.

• Establishes 13 factors for courts to consider when determining credible risk of abduction, including prior abduction attempts, threats, financial activities, ties to other states or countries, and risk of international abduction to non-Hague Convention countries.

• Authorizes courts to issue ex parte emergency orders and warrants for law enforcement to take physical custody of a child when abduction appears imminent, with respondent entitled to hearing within 72 hours.

• Permits courts to impose conditions such as supervised visitation, travel restrictions, passport surrender requirements, and bond posting as financial deterrents; becomes effective January 1, 2011.
