Amends Section 13A-6-21 of the Code of Alabama 1975 to expand the definition of assault in the second degree to include assaults on off-duty peace officers employed by private entities.

Provides that an off-duty peace officer employed by a private entity is considered a peace officer performing a lawful duty when working in an approved uniform with the approval of their employing agency.

Assault in the second degree remains a Class C felony, applicable when a person assaults a peace officer with intent to prevent them from performing lawful duties and causes physical injury.

Excludes the bill from Amendment 621 constitutional requirements regarding local expenditures because it defines or amends the definition of an existing crime.

Takes effect immediately upon passage and approval by the Governor or upon becoming law.
