SB287 Summary

• Amends Section 23-1-5 of the Code of Alabama 1975 to increase the gross income threshold for utilities eligible for state reimbursement of relocation costs from $200,000,000 to $250,000,000.

• Applies to utility facility relocations necessitated by construction of highways, roads, or streets that are not part of the national system of interstate and defense highways.

• State reimburses eligible utilities for relocation costs if they had gross income of $250,000,000 or less during the calendar year immediately preceding relocation, or in the first complete year of operation for newly organized utilities.

• Utilities exceeding the $250,000,000 threshold must pay relocation costs themselves; utilities meeting the threshold have costs covered by the state as part of highway construction expenses.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
