SB329 Summary

• Approves modified voluntary sentencing standards, worksheets, and instructions adopted by the Alabama Sentencing Commission on November 6, 2009, for implementation on or after October 1, 2010.

• Expands sentencing standards to cover additional offenses including attempts, conspiracies, and solicitations to commit murder and drug-related felonies (marijuana possession and distribution, controlled substance possession and distribution).

• Requires sentencing standards worksheets used to determine sentencing recommendations be filed with the trial court clerk and made part of the case record for all cases where standards are considered, effective October 1, 2010.

• Directs the Alabama Sentencing Commission to continue developing voluntary sentencing standards by collecting and analyzing sentencing data and incorporating a continuum of punishment options.

• Becomes effective immediately upon passage and approval by the Governor.
