SB345 Summary

• Expands existing drug donation law to allow legend drugs (prescription drugs) dispensed but not administered at hospitals, nursing facilities, assisted living facilities, and hospices to be donated to charitable clinics and charitable pharmacies for charitable patients.

• Establishes new category of "charitable pharmacy" as a registered retail pharmacy that dispenses free medications to low-income patients without charging for services and does not dispense controlled substances.

• Requires donated drugs to meet specific conditions: no longer needed by original patient, proper storage per pharmacopoeia standards, dispensed in unit dose or sealed packaging, and not expired.

• Authorizes physician drug samples (except controlled substances) to be donated and transferred to charitable clinics and charitable pharmacies.

• Provides liability protections for healthcare facilities, manufacturers, and their agents when transferring drugs in compliance with the law, except in cases of willful misconduct.
