SB396 Summary

• Adds Section 11-67-60.1 to the Code of Alabama 1975 to authorize municipal governing bodies to adopt alternative procedures for declaring overgrown grass and weeds as public nuisances.

• Allows municipalities to use alternate procedures different from existing article procedures to abate overgrown grass and weeds, as long as procedures are adopted by municipal ordinance.

• Requires abatement costs to be assessed and collected as a weed lien in the same manner provided in Section 11-67-66 of Alabama Code.

• Permits municipalities to assess abatement costs against property purchased by the State of Alabama or at tax sale, with the lien remaining in effect through any subsequent redemption or state sale of the property.

• Becomes effective immediately upon passage and approval by the Governor or upon otherwise becoming law.
