Prohibits the State of Alabama, its agencies, departments, commissions, political subdivisions, public institutions of higher education, and government instrumentalities from discriminating against or granting preferential treatment based on race, sex, color, ethnicity, or national origin in public employment, public education, or public contracting.

Allows bona fide sex-based qualifications that are reasonably necessary for the normal operation of public employment, public education, or public contracting.

Permits actions necessary to establish or maintain eligibility for federal programs if ineligibility would result in loss of federal funds to the state.

Declares any action taken in violation of this section void ab initio (void from the beginning).

Becomes effective on the first day of the third month following passage and approval by the Governor.
