SB581 Summary

• Proposes a constitutional amendment for Baldwin County requiring that only county-owned solid waste landfills may be used for disposal of garbage, household waste, industrial solid waste, and solid waste.

• Exempts pre-existing contracts (as of December 1, 2009), inert debris and construction materials disposal by municipalities, and on-site and privately-owned industrial landfills receiving only waste they generate.

• Caps county landfill rates at levels comparable to public and private landfill operators in Mobile, Escambia, Washington, Monroe, Clarke, Conecuh counties and Escambia County, Florida.

• Requires Baldwin County to establish a five-member Solid Waste Management Authority (including at least two municipal mayors) to recommend operational methods, rates, recycling programs, and revenue sharing arrangements.

• Provides that violations are misdemeanors punishable by fines of $50–$200 per day, and that the amendment automatically terminates three years after ratification unless extended by unanimous vote of the Baldwin County Legislative Delegation.
