SB72 Summary

• Amends Alabama Code Sections 11-47-60, 11-47-68, and 11-47-70 to require cemetery corporations, associations, religious bodies, and individual owners to obtain consent and approval from the governing body of the city, town, or county before declaring a cemetery abandoned.

• Allows reinterment of human remains from abandoned cemeteries to other Alabama cemeteries or memorial mausoleums/columbariums only with local government approval.

• Requires creation and maintenance of complete maps or plats identifying the location and names of reinterred remains, to be filed with the probate office of the county where the cemetery is located and any county where remains are relocated.

• Specifies that grave objects (vaults, monuments, headstones, copings) removed with human remains must stay with the remains and be reinstalled at the new burial site to duplicate the original configuration as closely as possible.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
