SB1 Summary

• Amends Section 29-2-4 of the Code of Alabama 1975 to expand the powers and duties of the Joint Transportation Committee.

• Authorizes the Joint Transportation Committee to call for and conduct administrative hearings to resolve civil disputes or conflicts between the Alabama Department of Transportation and private business individuals and entities.

• Grants the committee power to compel attendance of witnesses and production of documents and data necessary to conduct hearings.

• Requires the committee to strive to conduct administrative hearings consistent with concepts of judicial equity and may follow Alabama Center for Dispute Resolution guidelines, but is not required to adhere to them.

• Clarifies that administrative remedies provided through this act are not exclusive remedies and parties are not required to exhaust administrative remedies before pursuing other legal action; bill becomes effective the first day of the third month following passage and approval.
