HB110 Summary

• Amends Alabama Code Section 37-15-5 to require underground facility operators to either participate in a "One-Call Notification System" or operate their own in-house notification program for excavation and demolition notices.

• Operators with fewer than 10,000 customers or subscribers who maintain an in-house program are only required to provide service during business hours on working days and are not required to voice record notification calls.

• Makes operators who elect to operate an in-house program liable for damages to their underground facilities if an excavator contacted both the one-call system and the in-house program but the operator failed to meet operational requirements for receiving notifications.

• Requires one-call notification system operators to provide services on working days between 8 A.M. and 5 P.M., voice record calls, and maintain adequate records of notifications for at least three years.

• Becomes effective January 1 following passage and approval by the Governor.
