HB261 Summary

• Amends Section 13A-5-6 of the Alabama Code to add mandatory life imprisonment without possibility of parole for certain sex offenses against children.

• Defendants convicted of sex offenses under Sections 13A-6-61, 13A-6-63, or 13A-6-65.1 must receive life sentences without parole when the defendant was 21 years or older and the victim was 6 years of age or younger.

• Maintains existing sentencing requirements for Class A, B, and C felonies, including enhanced minimums when firearms or deadly weapons are used or for child sex offenses.

• Requires minimum 10 years of post-release supervision for offenders designated as sexually violent predators or convicted of Class A felony sex offenses involving children.

• Became effective on the first day of the third month following passage and Governor approval; passed House on April 21, 2011 and Senate on June 2, 2011.
