Marengo County judge of probate shall collect a special index fee of $5 on each real or personal property instrument, or other instrument recorded or filed in probate court.

The $5 fee is in addition to all other existing fees, taxes, and charges required by law for recording or filing instruments.

Collected fees shall be deposited into a special fund for improved recording, archiving, Internet technology, preservation, and retrieval of records.

Special fund may also be used for equipment, maintenance, training, and services to improve the recording, court, and license divisions of the probate office.

The act becomes effective on the first day of the first month following passage and gubernatorial approval, and does not alter existing law regarding probate fees.
