HB321 Summary

• Amends Alabama Code Sections 16-46-1 and 16-46-3 to reorganize and clarify definitions relating to school regulation and licensure requirements.

• Defines for-profit private schools as those operated as business corporations, partnerships, or proprietorships, and nonprofit schools as those established with nonprofit charters and determined by the IRS to be eligible for tax-deductible contributions under Section 501(c)(3).

• Changes the reference date for proprietary postsecondary institution accreditation from April 29, 1980 to July 1, 2004 for eligibility to retain exemption from licensure.

• Clarifies that courses offered through various methods (in-person, mail, correspondence, online, distance learning, telephone, or other advertising) fall under the regulatory scope.

• Becomes effective on the first day of the third month following passage and Governor approval.
