Active or inactive members with accrued benefits, or retired members of the Employees' Retirement System, Teachers' Retirement System, or Judicial Retirement Fund must forfeit employer-paid portions and all interest or gains on those portions upon guilty plea, no contest plea, or final conviction of a felony related to their official duties.

Forfeiture applies to convictions in Alabama state courts, any other state court, or United States federal courts, as declared by the presiding judge.

Forfeited benefits shall be applied to reimburse the employer for damages caused by the employee's illegal actions, with any excess amounts applied at the employer's discretion.

Officers and employees of the three retirement systems are granted immunity from civil or criminal liability for actions taken to enforce this forfeiture requirement.

The act becomes effective immediately upon passage and approval by the Governor.
