HB40 Summary

• Continues the existence and functioning of the Alabama Athlete Agents Commission under Alabama's Sunset Law, with modifications recommended by the Sunset Committee.

• Amends Section 8-26A-5 of the Code of Alabama 1975 to require that applicants for athlete agent registration be either United States citizens or persons legally present in the United States with appropriate federal documentation.

• Establishes comprehensive registration requirements for athlete agents, including submission of background information, business details, references, prior client representation, associated persons, and disclosure of any criminal convictions, disciplinary actions, or prior registration denials.

• Allows applicants holding valid athlete agent registration or licensure in another state to submit copies of their application and certificate from that state instead of a new Alabama application, provided the out-of-state application meets specified criteria.

• Became effective immediately upon passage and approval by the Governor.
