• Madison County Commission may levy a privilege or license fee of 12 percent on gross receipts from liquor sales for on-premises consumption by Alcoholic Beverage Control Board licensees in unincorporated Madison County.

• Commission may regulate and license the sale of alcoholic beverages for on-premises consumption by restaurants, including provisions for license issuance fees, revocation grounds, music/entertainment restrictions, food sales percentages, location restrictions, hours of operation, ownership restrictions, and building code compliance.

• Net proceeds from the privilege fee (after reasonable collection costs retained by the county) shall be distributed as follows: 50 percent to Madison County General Fund, 25 percent to Madison County Board of Education for supplies and equipment only, and 25 percent to volunteer fire departments using the same distribution percentages as the 3 mil ad valorem fire protection tax.

• Commission action requires adoption of a resolution by simple majority vote of the entire commission.

• Act becomes effective immediately upon passage and gubernatorial approval or upon becoming law otherwise.
