HB71 Summary

• Amends Section 24-1-28 of the Code of Alabama 1975 to require municipal public housing authorities to obtain municipal council approval before exercising the power of eminent domain.

• Authorizes authorities to acquire real or personal property by eminent domain when necessary to carry out their purposes, after adopting a resolution declaring the acquisition is in the public interest and necessary for public use.

• Prohibits acquisition of property belonging to any city within the authority's boundaries or any government without their consent.

• Prohibits acquisition of property belonging to public utility corporations without approval from the Public Service Commission or other applicable regulatory body.

• Takes effect on the first day of the third month following passage and gubernatorial approval.
