Active or inactive members with accrued benefits or retired members of the Employees' Retirement System, Teachers' Retirement System, or Judicial Retirement Fund shall forfeit the employer-paid portion of retirement benefits upon guilty plea, no contest plea, or final conviction of a felony offense related to performance of official duties.

Forfeiture includes interest and gains earned or accumulated on the employer-paid portion of retirement contributions.

Conviction may occur in a United States federal court, Alabama court, or any other state court, with the presiding judge declaring the offense was related to duties of public office.

Officers and employees of the three retirement systems are immune from civil or criminal liability for actions taken pursuant to the act.

The act becomes effective immediately upon passage and approval by the Governor, or upon otherwise becoming law.
