Deletes the minimum penalty amount of $100.00 for civil penalties assessed by the Alabama Department of Environmental Management, leaving only the maximum penalty of $25,000.00 per violation.

Provides that the total penalty assessed in a single department order shall not exceed $250,000.00.

Establishes appeal procedures allowing persons subject to penalty orders to request a hearing before the Environmental Management Commission within 30 days of order issuance.

Allows further appeal of commission decisions to the Alabama Court of Civil Appeals, rather than limiting appeals to circuit court.

Becomes effective immediately upon passage and approval by the Governor.
