SB 202 Summary

• Prohibits qualified health plans offered through health insurance exchanges created under the Patient Protection and Affordable Care Act (P.L. 111-148) from providing abortion coverage in Alabama.

• Allows Alabama to affirmatively opt out of the federal default that permits health insurance plans covering abortions to receive federal subsidies through state exchanges.

• Exempts abortions when the mother's life is endangered by physical disorder, illness, or injury caused by the pregnancy, or when pregnancy results from rape or incest.

• Clarifies the act does not create or recognize a right to abortion and does not legalize abortions that are currently unlawful under state law.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
