Contractor and subcontractor liability for highway, road, or street repairs, construction, or maintenance ceases upon project acceptance as substantially compliant with contract documents, plans, and specifications by the Alabama Department of Transportation, county, or local government.

Contractors and subcontractors, along with their officers, directors, agents, and employees, bear no civil liability for property damages, injury, death, or other claims by third parties arising from project design or engineering by the public authority.

Contractors and subcontractors are not liable for roadway conditions or defects outside the project scope or arising after project acceptance, nor are they responsible for owner decisions regarding project scope or post-completion maintenance.

The law applies only to causes of action accruing after the effective date, with accrual determined at the time of property damage or injury/death occurrence.

The act becomes effective immediately upon passage and approval by the Governor, or upon otherwise becoming law.
