SB 327 Summary

• Requires secondary metals recyclers to maintain copies of seller identification cards and video or photographic copies of IDs, with additional information when the person delivering metal property differs from the person receiving payment.

• Mandates secondary metals recyclers notify the county sheriff of their business location and authorizes sheriffs to conduct inspections of proposed business sites to verify compliance with regulations.

• Limits purchase of catalytic converters to one per day from the same person (except from licensed dealers or other secondary metals recyclers), and prohibits purchase of cemetery bronze objects without cemetery and law enforcement written permission.

• Prohibits secondary metals recyclers from purchasing metal property from persons under 18 years of age and requires dealers/wreckers transporting vehicles across state lines for scrap to first obtain certificate of title and maintain records for three to five years.

• Establishes criminal penalties including Class C felony for purchasing stolen bronze cemetery markers, Class A misdemeanor for purchasing from minors, and Class A misdemeanor for transporting untitled vehicles across state lines for recycling.
