SB466 Summary

• Proposes a constitutional amendment to transfer all assets and liabilities of the Water Works and Sewer Board of the City of Prichard to the Board of Water and Sewer Commissioners of the City of Mobile (Mobile Area Water and Sewer System) within 90 days of ratification.

• The Mobile board must assume all of Prichard's liabilities including indebtedness, contracts, and retirement obligations, evidenced by board resolution.

• Upon completion of the asset transfer, the Prichard Water Works and Sewer Board shall be dissolved.

• Prohibits rate increases to existing Mobile Area Water and Sewer System customers for reasons related to the acquisition or maintenance of Prichard's assets, liabilities, or infrastructure.

• Amendment becomes effective only if approved by majority vote in both service areas: precincts served by Mobile Area Water and Sewer System and precincts served by Prichard's Water and Sewer Board, with votes tabulated separately for each area.
