SB57 Summary

• Parents or legal guardians of children with an individualized education program (IEP) may transfer their child from any public school or school district to any other public school or school district in Alabama.

• The receiving school must provide free appropriate public education including services comparable to those in the child's previous IEP until it adopts the previous IEP or develops and implements a new one.

• The receiving school must take reasonable steps to promptly obtain the child's records from the previous school, including the IEP, supporting documents, and special education records.

• The previous school must take reasonable steps to promptly respond to requests for the child's records from the new school.

• The act becomes effective immediately upon passage and approval by the Governor.
