SB80 Summary

• Removes the exemption that previously allowed fly ash waste, bottom ash waste, boiler slag waste, and flue gas emission control wastes from coal or fossil fuel combustion at electric generating plants to be excluded from solid waste regulation.

• Establishes a new definition of "coal combustion by-products" in Alabama Code Section 22-27-2 to identify these materials for regulatory purposes.

• Makes coal combustion by-products subject to solid waste disposal requirements under Alabama Code Section 22-27-3 until federal regulatory requirements under the Solid Waste Disposal Act take effect.

• Allows facilities permitted by the Alabama Department of Environmental Management prior to the effective date to continue operating without additional authorization until federal requirements take effect.

• Authorizes the department to develop state regulatory rules for coal combustion by-product disposal consistent with future federal requirements and to allow beneficial uses as an alternative to disposal where permitted.
