SB84 Summary

• Limits landowner liability for damages to persons using property leased for hunting or fishing purposes under the "Landowners Protection Act."

• Landowners remain liable if they have actual knowledge of a dangerous, non-obvious condition at the time of lease and fail to disclose it to the lessee, and the danger causes injury, damage, or death.

• Landowners remain liable if they intentionally or willfully cause injury to a person rightfully using the leased property.

• Does not affect existing open and obvious doctrine or the liability of third parties leasing the land.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
