SB85 Summary

• Limits liability of agritourism professionals for injuries or deaths resulting from inherent risks of agritourism activities, including land conditions, animal behavior, equipment dangers, and participant negligence.

• Requires agritourism professionals to post warning notices with letters at least one inch in height at the main entrance stating that professionals are not liable for injuries from inherent risks of the activity.

• Mandates written contracts between agritourism professionals and participants for professional services, instruction, or equipment rental must include the required warning notice in clearly legible print.

• Preserves liability for agritourism professionals who have actual knowledge of dangerous conditions and fail to disclose them, improperly train employees, commit willful or wanton disregard for participant safety, or intentionally injure participants.

• Exempts activities where participants are paid to participate and does not apply to professionals who fail to comply with signage and warning notice requirements; becomes effective on the first day of the third month following passage and approval.
