HB115 Summary

• Contractors and subcontractors performing highway, road, or street repairs, construction, or maintenance for the state, counties, or local governments cease to have civil liability upon project acceptance as substantially compliant with contract documents, plans, and specifications.

• Contractors and their officers, directors, agents, and employees bear no civil liability for property damages, injuries, deaths, or other claims by third parties arising from design or engineering decisions made by the Alabama Department of Transportation or other public agencies.

• Contractors are not responsible for roadway conditions or defects outside the project scope or arising after project acceptance, nor for maintenance responsibilities that are the public owner's responsibility following substantial completion.

• The act applies only to causes of action accruing after the effective date, with causes of action deemed to accrue at the time of property damage or injury occurrence.

• The act becomes effective immediately upon passage and gubernatorial approval or upon becoming law through other means.
