Public housing authorities in Class 3 municipalities (except those organized under Act 618 of 1973) must obtain approval from the municipal governing body before exercising eminent domain powers.

Public housing authorities in affected Class 3 municipalities may only purchase real property for public housing purposes after providing written notice to surrounding property owners.

Notice of intent to purchase must be sent via first class mail to all residential and business addresses within 300 yards of the property at least 30 days before executing any binding purchase agreement.

Existing law permitting property acquisition without consent from cities, governments, and public utilities remains unchanged for all other municipalities and authorities.

The act becomes effective on the first day of the third month following passage and approval by the Governor.
