HB18 Summary

• Amends sections 13A-8-31, 13A-8-35, and 13A-8-37 of the Alabama Code to strengthen regulations on secondary metals recyclers, including requirements for detailed transaction records, photographic documentation, and vehicle identification information.

• Requires secondary metals recyclers to pay for metal purchases by check (except for transactions under $100 for copper or $1,000 for other metals) and to electronically report transactions to law enforcement within 24 hours upon request, with a mandatory 3-day holding period for inspections.

• Prohibits secondary metals recyclers from purchasing specific metal property (cemetery bronze items, manhole covers, utility equipment, historical markers, catalytic converters, etc.) without written proof of ownership or authorization, and prohibits purchases from persons under age 18.

• Establishes criminal penalties including Class A misdemeanor (under $250 in value) and Class C felony (over $250) for selling stolen metals, with mandatory restitution ordered at sentencing.

• Creates new felony offenses for damaging or stealing telecommunications, electric power, or farm infrastructure; requires recyclers to notify sheriffs before opening new locations; effective 60 days after passage.
