• Creates the "Fair and Open Competition in Governmental Construction Act" to regulate public agency construction contracts and grant awards in Alabama.

• Prohibits public agencies and construction managers from including terms in bid specifications or contracts that require, prohibit, encourage, or discourage bidders and contractors from entering into collective bargaining agreements.

• Prohibits public agencies from conditioning grants, tax abatements, or tax credits on requirements that awardees include union-related terms in construction contracts for real property improvements.

• Does not restrict employers' rights under the National Labor Relations Act or prevent agencies from awarding contracts to unionized contractors, provided union status is not a condition of award and there is no discrimination.

• Applies to public construction contracts executed on or after November 1, 2012, and becomes effective the first day of the third month following passage and approval.
