HB385 Summary

• Adopts a revised Alabama Code of Military Justice (ACMJ) substantially similar to the federal Uniform Code of Military Justice for disciplining Alabama National Guard members during non-mobilized periods.

• Establishes courts-martial system with Summary, Special, and General courts-martial that can impose sentences including bad-conduct discharge and up to one-year county jail incarceration.

• Grants commanders authority to impose non-judicial punishments for minor offenses including forfeiture of pay, reduction in grade, extra duties, and restriction, with graduated authority based on rank.

• Provides military-specific disciplinary offenses including AWOL, insubordination, forgery of military records, assaults on superiors, and drug positives.

• Repeals prior military discipline sections (31-2-92 to 31-2-98, 31-2-101, 31-2-103, and 31-2-127) and becomes effective upon Governor approval and adoption of implementing guidelines by the Adjutant General.
