HB387 Bill Summary

• Amends Section 11-44G-2 of the Code of Alabama 1975 to exclude Class 7 and 8 municipalities with 12,000 or more inhabitants from its mayor vacancy procedures.

• Class 7 and 8 municipalities with 12,000 or more inhabitants shall fill mayoral vacancies under Section 11-43-42(a), where the council president succeeds to the office upon vacancy.

• Removes the potential conflict between Section 11-44G-2 (which allows council appointment, gubernatorial appointment, or special election) and Section 11-43-42(a) (which provides for council president succession) for larger municipalities.

• Becomes effective on the first day of the third month following passage and approval by the Governor, or upon otherwise becoming law.
