Active or inactive members of the Employees' Retirement System, Teachers' Retirement System, or Judicial Retirement Fund who have accrued benefits shall forfeit retirement benefits upon guilty plea, no contest plea, or final conviction of a felony offense related to their public position.

Members forfeiting benefits shall receive a refund of their retirement contributions plus applicable interest as determined by the presiding judge in federal, Alabama, or other state courts.

Retired members receiving benefits shall have their retirement benefits suspended upon such plea or conviction, and receive a partial refund of contributions and interest if they have not already received benefits exceeding their contributions.

Officers and employees of the three retirement systems are granted immunity from civil or criminal liability for actions taken pursuant to this act.

The act becomes effective immediately upon passage and gubernatorial approval.
