AL HB43

Establishes the Health Care Compact to return regulatory authority over health care from the federal government to participating member states, requiring congressional consent under Article I, Section 10 of the Constitution.

Creates the Interstate Advisory Health Care Commission composed of members appointed by each member state (no more than two per state) to study health care regulation issues and provide non-binding recommendations to member legislatures.

Authorizes each member state to suspend conflicting federal health care laws, rules, and regulations within its borders and to regulate health care according to state law and judgment.

Provides federal funding to member states equal to their Member State Current Year Funding Level (calculated from 2010 federal baseline spending adjusted for population and inflation changes), funded as mandatory congressional spending without annual appropriation.

Takes effect on adoption by at least two member states and with congressional consent; allows member states to withdraw with six months' notice and permits unanimous amendments by member states without prior congressional approval.
