Montgomery County Commission may contract with private, public, or governmental entities for service of process with the sheriff's concurrence, except for service of arrest warrants.

Imposes an additional service of process fee of $30 per document for service or attempted service in both criminal and civil divisions of Montgomery County district and circuit courts.

Court officials collect the $30 fees and remit them to the Montgomery County Commission for deposit in the county general fund.

District attorney, law enforcement, and grand juries are exempt from paying the service of process fees.

The court may waive the fee if payment would create substantial hardship, upon filing a verified statement with the clerk of court.
