HB 690 Summary

• Amends Section 11-52-30 of the Code of Alabama 1975 to lower the population threshold for county planning and zoning commission authority from 600,000 to 400,000 inhabitants based on the 2010 federal census or subsequent decennial census.

• Grants county planning and zoning commissions in counties with 400,000 or more residents authority over subdivision jurisdiction, except where municipalities actively exercise zoning or subdivision jurisdiction and control.

• Authorizes county commissions in counties with 400,000 or more inhabitants to establish minimum specifications and regulations governing street layout, grading, paving, and utility installation in subdivisions outside municipal corporate limits.

• Clarifies that municipal planning commissions may not exercise eminent domain or levy taxes and fees outside their corporate limits.

• Became effective on the first day of the third month following passage and approval by the Governor, with House passage on May 1, 2012 (99 yeas, 0 nays).
