HB744 Summary

• Prohibits Alabama state agencies, political subdivisions, employees, and Alabama National Guard or State Defense Force members from knowingly assisting the United States Armed Forces in detaining any citizen under 50 U.S.C. § 1541 (National Defense Authorization Act for fiscal year 2012, § 1021)

• The prohibition applies only when such assistance would violate the United States Constitution, Alabama Constitution of 1901, Alabama Code of 1975, state legislative acts, or Alabama Administrative Code

• Exempts state and local law enforcement and the Alabama National Guard or State Defense Force from the prohibition when participating in joint task forces, partnerships, or cooperative agreements with federal law enforcement, provided the purpose is not to participate in detentions under § 1021 of the National Defense Authorization Act for fiscal year 2012

• Takes effect on the first day of the third month following passage and approval by the Governor, or its otherwise becoming law
