HB 769 Summary

• Requires all hospitals licensed by the State Board of Health that perform mastectomy surgery, lymph node dissection, or lumpectomy to provide written information to patients about breast reconstructive surgery options prior to obtaining surgical consent.

• Information must include a description of various reconstructive options with their advantages and disadvantages, coverage provisions under public and private insurance plans under federal and state law, and how patients may access reconstructive care.

• Patients must be informed they can transfer care to a facility providing reconstructive services or pursue reconstruction after completion of breast cancer surgery and chemotherapy or radiotherapy.

• The State Board of Health may require additional information beyond the specified minimum requirements.

• The act becomes effective on the first day of the third month following passage and approval by the Governor.
