HB87 Summary

• Expands the definition of "abandoned motor vehicle" in Alabama Code to include vehicles where the driver has been arrested, is injured, or the vehicle otherwise needs immediate removal as determined necessary by law enforcement officers.

• Authorizes law enforcement officers to have motor vehicles towed if the vehicle is subject to an impoundment order for outstanding traffic or parking violations.

• Establishes that towing agents and wrecker services have a lien for reasonable removal and storage fees when authorized by law enforcement officers.

• Limits liability for law enforcement officers and removal services to cases of gross negligence only when removing vehicles under this authority.

• Becomes effective immediately upon passage and approval by the Governor.
