Amends Section 5 of Act 2001-224 (the Lewis Spratt Act) to modify when Birmingham City Board of Education members assume office.

Initial elected board members shall assume office immediately upon certification of election results and serve initial terms expiring at the same time as corresponding city council member terms.

Subsequent board members shall assume office on the fourth Tuesday in October after their election and serve the same term length as Birmingham City Council members.

Requires the Birmingham City Council to ensure compliance with the Federal Voting Rights Act of 1965 and coordinates board elections with mayoral elections.

Becomes effective on the first day of the third month following passage and approval by the Governor.
