SB188 Summary

• Amends Section 7 of Act 2009-649 to modify the disbursement of pretrial diversion program fees in St. Clair County.

• Establishes application fees for offenders approved for pretrial diversion: felony offenses up to $1,000, misdemeanor offenses up to $750, traffic offenses up to $500, and violations up to $100.

• Authorizes additional fees for arresting/ticketing agencies, the Department of Forensic Sciences Jacksonville Lab for drug-related offenses, and the Circuit Clerk of St. Clair County (up to $100 each for appropriate offense categories).

• Designates application fees to be used by the District Attorney for employing officers or staff, purchasing equipment or supplies, providing training, or supporting local and state law enforcement agencies.

• Prohibits denying applicants access to the pretrial diversion program based solely on inability to pay, and allows the District Attorney to waive or reduce fees for just cause, including indigency.
